Our Customer Service Policy and Terms & Conditions includes the following headings;

30 Day Money Back Guarantee, Returns, Refund & Exchange

We offer a thirty (30) day money back guarantee for kayaks purchased from December 1st 2014. Kayaks can be used but not damaged. Return items must be returned by the purchaser, at the purchasers cost & repackaged for safe travel. Refund items that are damaged during return transportation will not be accepted. Opened and used products after thirty (30) days from purchase are non refundable or exchangeable. The thirty (30) day money back guarantee on the product does not waiver the warranty offered on each product.

This money back guarantee on kayaks is limited to normal use. It is void if damage has resulted from accident, dismantle, abuse, transport, improper use of handling or service or modification by someone other than the appointed vendor. Not covering kayaks used commercially. Not covering Vue clear double canoe or Vue 2 and Vue 3 clear bottom kayak.

You shall inspect the goods immediately upon their arrival and contact Kayaks WA if the goods are not in accordance with specified requirements. If you fail to give such notice within thirty (30) days from the receipt of goods, the goods shall be deemed to be in all respects in accordance with the the specified requirements. No claim shall be recognised unless made in writing and received by Kayaks WA within thirty (30) days after receipt of goods by you.

The total amount of any claim shall not exceed the actual invoice value of the goods claimed to be faulty and excludes all shipping / delivery costs.

If Kayaks WA is found responsible for any damages, Kayaks WA is responsible for actual damages only. In no event shall Kayaks WA, be liable for any incidental, indirect, exemplary, punitive and/or consequential damages, lost profits, or damages resulting from lost data or business interruption resulting from the use of or inability to use the website or its products.

Warranties & Replacement Parts

For the original customer all our brand new kayaks (repair or replace) are warranted against material or manufacturing defects in the hull and deck for one (1) year from the date of original purchase of the kayak.

For the original customer parts and accessories factory fitted to each kayak are warranted (replace) for five (5) years of your product against material or manufacturing defects from the date of purchase, this excludes the following components cushion, scupper plugs, mesh bag, foam seat, knee brace, thigh brace & rudder. Parts supplied by Kayaks WA to be fitted by the purchaser.

All Demo, Used, Refurbished or Seconds Grade kayaks sold to the customer is accepted in As Is condition and are excluded from warranty claims. Replacement parts for most components will be available for purchase from Kayaks WA.

This warranty is limited to normal use. It is void if damage has resulted from accident, dismantle, abuse, transport, improper use of handling or service or modification by someone other than the appointed vendor.

Retain a copy of your invoice and locate the Kayak Identification Number of the kayak as evidence of original customer and kayak hull identity and purchase date.

If you have a problem with your kayak and you suspect that it may be due to defective materials or workmanship the purchaser is responsible for the delivery to Kayaks WA’s agent for an inspection, alternatively photographic evidence will be provided via email to info@kayakswa.com.au to the satisfaction of Kayaks WA, prior to the return or replacement of warranted items.

If any item is returned and / or repaired is over the period of warranty, any costs will be charge to the purchaser for the repairs and delivery costs incurred.

5 Year replacement parts not covering kayaks used commercially and not covering Vue clear double canoe.

Lay-By

Lay-by’s are offered and become active when a minimum $50 deposit is paid on the item. Payments can be made with Visa, Mastercard and by Bank Transfer. Lay-by’s must be fully paid and collected within 8 weeks of the deposit date. $50 will be retained by Kayaks WA if the lay-by is cancelled for any reason after 1 week from the deposit date and after expiry of the layby if the lay-by extends beyond the 8 weeks period. Leniency will be considered to the complete satisfaction of Kayaks WA.

Refer to Kayaks WA's detailed Privacy Policy. This policy covers how we use your personal information. We take your privacy SERIOUSLY and will take all measures to protect your personal information.

Credit & Debit Cards

Payment by credit card, can be made over the phone. A receipt will be emailed to the purchaser after payment has been received.

We accept all credit cards displaying the Visa or MasterCard logo. Kayaks WA do not keep any records of our customers credit card details. Your credit card will be charged when you place your order. If we are not able to fulfill your order for any reason your credit card will be refunded.

Direct Deposit

Direct Deposit by electronic funds transfer from a bank account can be made to our bank details below;

Please quote your order number (displayed after checkout confirmation) when making your deposit. Orders will be processed once payment has been received.No delivery or pick-up of items will be possible until payment in full has been received.

Paypal 

If offered you can checkout using Paypal, if selected you will be redirect to Paypal’s secure website payment gateway here you will be able to login to your existing account or checkout as a guest using your credit card details. Kayaks WA also use Paypal to send invoices via email with a link for payment via Paypal. A receipt will be emailed to the purchaser after payment has been received.

Rejecting payments

We reserve the right to refuse any orders or purchases that appear fraudulent or suspicious. We reserve the right to request further verification if needed.

How do I apply a coupon code?

Go to your shopping cart and you will see a field to enter a Coupon/Promo Code. Type it in and hit "Apply". It's that simple!

Coupons and Promotions Policies:

  • All coupons are limited to one coupon per order, unless advised otherwise.
  • Coupons are not valid after your order has been shipped. We charge orders at the time of shipment, so if your order has been dispatched, we can no longer apply a coupon code.
  • Coupons and promotions are issued with expiration dates and are valid while supplies last.
  • Some coupons are valid only on certain products.
  • Coupons cannot be replaced if the code is lost or stolen.
  • Dollar-off or percentage-off coupons are applied to the merchandise subtotal before any shipping charges or taxes have been applied.
  • If you cancel or return item(s), this may change or void coupon discounts applied to your order. This happens when the cancellation or return causes the merchandise subtotal (before any shipping charges or taxes have been applied) to fall below the minimum requirement.
  • If you return an item that was purchased with a coupon, you will be refunded only the amount you paid (that is, the price of the item, less the coupon value).

Shipping & Delivery

Pick-Up Details

A Local Pick-up time can be arranged by emailing info@kayakswa.com.au or calling us on 0413 153 071.

Handling, loading & unloading of the the purchased goods is at the purchasers risk.

Shipping & Delivery

Perth Metro deliveries we will contact you to arrange a suitable delivery time. Delivery will usually be within 1-7 days unless arranged otherwise.

Non Metro / Country deliveries are weekly, subject to stock availability, delivery days vary. Delivery insurance is optional and the responsibility of the purchaser.

We will nominate a delivery time frame, it is requested that the purchaser nominate a suitable person to attend delivery of the purchased item/s as a signature may be required at delivery.

Handling, loading & unloading of the the purchased goods is at the purchasers risk.

We will attempt to deliver to the address nominated by you.  Delivery is deemed to be affected when:

we receive a signed receipt or delivery docket, and/or;

  • if that address is unattended, delivery is deemed to have occurred and we may leave the goods at that address unattended, and/or;
  • if the address of delivery is unattended and we elect to re-deliver goods to you, the receiver or a third party/address, we will charge you for the costs of the re-delivery including any storage costs we may incur.  You guarantee to pay any additional charges within seven (7) days of notification;
  • a depot or regional agent does not service a regional location and the receiver must pick up from the local depot.

We will not in any circumstance deliver goods to a post office box.

A 'door to door' service is not possible in some locations throughout Australia (e.g. farms, addresses outside of regional towns, etc.).

Also, if goods are too heavy or large and a driver cannot safely pickup or deliver the goods on their own, the consignment must be dropped off or picked up from a local depot by the customer. Costs for this are to be borne by the customer.

You are entirely responsible for insuring the goods we transport. If you fail to insure such goods we are not to be held liable to you in any way under the Contract.

Order Tracking

If a tracking number is provided by the shipping carrier, we will update your order with the tracking information.

Shipping Rates

The rate charged for the shipping of your order is based on the packaging, weight and dimensions of your products, and your location. Before the final checkout page you will be shown what the cost of shipping will be, and you will have a chance to not place your order if you decide not to.

Back Orders

If an item goes on backorder we will ship you the part of your order that is in stock. When the item becomes available we will ship you the rest of your order. You will not be charged any additional shipping and handling for the second shipment.

Kayaks WA makes no representations or warranties about the accuracy, completeness, security or timeliness of the content, information or services provided by the website and disclaims all warranties, either express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties' rights, and fitness for a particular purpose.

14. Limitation of Liability

If Kayaks WA is found responsible for any damages, Kayaks WA is responsible for actual damages only. 15. General Conditions of Sale

The following Conditions of Sale shall apply to any product sold on this website. These Conditions of Sale constitute a complete and exclusive statement of the agreement and understanding between you and Kayaks WA with respect to the subject matter hereof.

15.a. The goods delivered under this Agreement shall be of normal industrial quality unless herein specifically stated to the contrary. Any description of such goods has been given by way of identification only and the giving or use of such description shall not constitute any sale hereunder a sale by description.

15.b. The products available on the website for sale under these Conditions of Sale are only available for sale to individuals who can make legally binding contracts. The products are not available to persons under the age of 18 years nor any other person legally prohibited from entering into a binding contract. By placing your order you are verifying to the Kayaks WA that you are able to make a legally binding contract.

15.c. Your order is an offer by you to purchase a particular product for the price (including the delivery and other charges and taxes) specified on the website at the time of offer and shall be understood to be placed under these Conditions of Sale.

15.d. These Conditions of Sale may change from time to time and you are required within reason to revisit these before placing your order to ensure that these Conditions of Sale have not changed.

15.e. Kayaks WA reserves the right to accept or reject your offer for any reason, including, without limitation, an error in the product description or the price posted on the website, the availability of the product, or an error in your order. Your contract with Kayaks WA only comes into existence when Kayaks WA forwards you an email containing confirmation of receipt of your order, an acceptance of your order, confirmation of receipt of your payment and details of likely delivery.

15.f. This contract shall be governed by and construed in accordance with the law in effect in the State of WA and by entering into contract both parties are accepting the jurisdiction of the courts of the State of WA in relation to any dispute between them.

15.g. You shall inspect the goods immediately upon their arrival and shall within seven (7) days give notice to Kayaks WA if the goods are not in accordance with specified requirements. If you fail to give such notice, the goods shall be deemed to be in all respects in accordance with the specified requirements. No claim shall be recognised unless made in writing and received by Kayaks WA within seven (7) days after receipt of goods by you. The total amount of any claim shall not exceed the actual invoice value of the goods claimed to be faulty.

15.h. Ownership and property in the goods supplied/delivered shall pass from Kayaks WA to you when Kayaks WA accepts your offer and assigns product in the Kayaks WA warehouse. Risk passes to you upon delivery to your warehouse or to an agreed delivery point.

15.i. Kayaks WA shall not be responsible for non-delivery or delay in delivery of any goods caused by force majeure and you and Kayaks WA shall be excused from performance of their respective obligations when and to the extent such performance is delayed or prevented by force majeure. If your need for the goods is reduced or suspended as a result of force majeure, and notification is within reasonable time of acceptance of the Order and prior to transfer of ownership, you shall be entitled to terminate the agreement. For the purpose of this commitment force majeure shall include but is not limited to natural disasters, civil disasters, political event, change of legal / political environment, business disruption, accidents, earthquake, flood, hurricane or typhoon, tornado, tsunami, volcanic eruption, wildfire/bushfire, landslide or avalanche, fire, flood, storm, earthquake, terrorist acts, revolt, war, financial markets disturbances, changes of regime or tax or regulatory authority, energy failure, external telecommunications failure, and/or failure of transport systems.

15.j. You assume all risks and liabilities for consequences arising from the use of the goods whether singly or in combination with other goods and indemnify Kayaks WA in respect of any such use. Kayaks WA is not liable for any infringement of patent rights arising out of the use of such goods by you or your instructions, expressed or implied, and it is your responsibility of to ensure that the goods when used by you are not damaged and no liability will be accepted by Kayaks WA for the consequences of the use of damaged goods by you.

15.k. Nothing in these Conditions of Sale is intended to exclude, restrict or modify any statutory obligation of Kayaks WA implied by the Goods Act, 1958.
